I think you mix up the Supreme Court's strict scrutiny "1)only means" to fulfill "2)compelling interest" requirements with the rational basis test, which only needs "legitimate interest". If the Court used strict scrutiny, Proposal 8 surely wouldn't survive. It is truly amazing the Equal Protection Clause was enacted into law in 1868 and gay people still can not get legally married. The 1st and 14th amendement protect us! They need to use a rational basis test similar to the one they did in Lawrence v Texas.
